By accessing and using the Garden Stack website (gardenstack.be) and purchasing our products, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

We reserve the right to update these terms at any time. Continued use of the website after changes constitutes acceptance of the revised terms. We encourage you to review this page periodically.

3. Products and Availability

All products listed on Garden Stack are described as accurately as possible. However, we do not warrant that product descriptions, images, pricing, or other content are entirely error-free, complete, or current.

We reserve the right to:

• Modify or discontinue any product without prior notice
• Limit quantities available for purchase
• Refuse or cancel orders at our discretion, including orders that appear to be placed by resellers or distributors

In the event of product unavailability after an order has been placed, we will notify you promptly and offer a full refund.

4. Pricing and Payment

All prices are displayed in Euros (EUR) and include VAT where applicable. Prices are subject to change without notice, but changes will not affect orders already confirmed.

Payment is processed securely through Stripe. We accept major credit and debit cards. By placing an order, you confirm that the payment method used is yours or that you are authorised to use it.

An order is confirmed only once payment has been successfully processed and you receive an order confirmation email.

5. Shipping

We offer free shipping within Belgium on all orders. Orders are typically delivered within 1–3 business days after dispatch.

6. Returns and Cooling-Off Period

In accordance with Belgian and EU consumer law (Book VI of the Belgian Code of Economic Law), you have the right to withdraw from your purchase within 14 days of receiving your order, without providing a reason.

In addition, we offer a 30-day satisfaction guarantee. If you are not satisfied with your purchase for any reason, you may return it within 30 days of delivery for a full refund.

7. Warranty

All Garden Stack products come with a 2-year manufacturer warranty in accordance with EU Directive 2019/771 on the sale of goods. This warranty covers manufacturing defects and material failures under normal use.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Fontaine Farm SRL shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, goodwill, or other intangible losses
• Damages arising from the use or inability to use our products or services
• Any third-party actions or content

Our total liability for any claim arising from or related to these terms shall not exceed the amount you paid for the specific product or service giving rise to the claim.

Nothing in these terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under Belgian law.

9. Intellectual Property

All content on this website — including but not limited to text, images, logos, graphics, designs, and software — is the property of Fontaine Farm SRL or its licensors and is protected by Belgian and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.

10. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with Belgian law. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
